Physics Research Assignment Essay

Introduction The study of physics has had a large impact on the development of road safety. The study of Newton’s Laws, impulse and momentum help to reduce initial momentum or decrease impulse (rate of change of momentum) to protect passengers. Technological advances and studies of vehicle crashes increase the automobile industry’s understanding of the forces involved and ways of reducing effects of collisions. Within vehicles, many car safety devices are installed, such as seat belts, air bags, crumple zones and head rests. Modern road design reduces the initial or rate of change of momentum and consequently the impact of collision through crash barriers, speed zones and speed humps. Car safety devices Seatbelts Seatbelts are designed so that passengers are restrained instead of continuing to move forward at the car’s speed when the brakes of a moving vehicle are applied. In this situation, there is a tendency for a body to resist changes to its motion, called inertia. (Newton’s first law) The stopping force is applied to the more durable parts of the body such as hips, chest and shoulder. This is instead of the human head crashing into windshield if no seat belt is worn. Inertia reel seatbelts Inertia reel seatbelts have a cylinder that stores extra belt material on a spool. The spool turns freely normally for movement. In the event of a sudden change in velocity, a pendulum in the reel plunges forward to lock and restrain the occupant. It is named ‘inertia reel’ due to the inertia of the pendulum to cause belt locking. Different types of seatbelt The lap seatbelt is tightened over the pelvis and absorbs force over a sizeable area. However they do not prevent the head and upper body from lurching forward in response to deceleration and are inadequate especially for front passengers, who risk hitting the windscreen. The lap sash seatbelt combines a lap seatbelt over the pelvis as well as over one shoulder across the chest. This greatly limits movement of the upper body and head as well as spreading the stopping force over a larger area. Shoulder harnesses restrain upper torso movement even further. Two are belts fall over the shoulders and an optional strap lies over the sternum. It is effective in the way force is spread over both shoulders compared to one shoulder in lap sash. Shoulder harnesses are usually used in child restraint systems and racing cars. The nylon webbing material in seatbelts is slightly flexible so that the stop is not as abrupt. Airbags Airbags provide an extra degree of protection in a collision by cushioning passengers in a collision, greatly limiting fatalities and serious injury. They are designed to increase the time interval during which the driver’s momentum decreases in a collision to decrease the net force of the driver. They inflate when crash sensors detect large deceleration. Sensors then ignite the sodium azide, producing sodium compounds and nitrogen gas for a reactive explosion. The airbags inflate rapidly to cushion the impact of the passenger against the steering wheel, dashboard or windshield. Airbags are to be used with seatbelts, not as a replacement. A disadvantage of airbags is they provide no protection against side-on hits, only frontal collisions. More expensive cars are developing side airbags to combat this. Head rests Padded headrests provide protection in rear end collisions. When a car is rear-ended, a large net force pushes the car and it accelerates forward. The inertia, based on Newton’s first law, pushes the passenger into the seat. Without a head rest for support, the head remains at rest until the spine pulls it forward. This sudden, sharp acceleration for the head causes it to fling back and results in hyperextension and whiplash injuries. Crumple Zones Many cars are designed to crumple at the front and rear. Crumple zones increase the time interval during which the momentum of the car changes during a collision, thus lessening the forces. Newton’s second law (f=ma) can be applied, as increased ?time will result in a decreasing rate of deceleration ‘a’ and consequently reduce force. Crumple zones are built using the integration of steel and fiberglass in the front and rear end assemblies of the automobile. Rigid structures between crumple zones protect the passenger compartment. In a collision, the crumple zones deform to slow the actual impact. The car doesn’t regain all its original kinetic energy, as some of this is converted to heat and sound energy to reduce damage to passenger area through smaller forces. As crumple zones are placed in strategic locations, the collapse is controlled and energy from impact is directed away from passenger area. Road design Speed humps and low speed zones Local councils introduced Speed Humps to reduce the overall speed of cars. Evidence shows that slower moving cars cause less damage to occupants if a crash results. It has been estimated that risk of death or serious brain damage doubles with every 16km/h over 80km/h. Speed humps restrict drivers from speeding as hitting the hump too fast can cause car damage. Low speed zones also reduce the speed of cars. A reduction of speed will reduce the chance of an accident as drivers have more time to react as well as decreasing the change in momentum and associated inertial forces in collisions. The police enforces speed signs and limit zones and speeding is monitored by speed cameras. In NSW, the general urban limit is 60 km/h for roads in built up areas where there are pedestrians. Crash Barriers Crash barriers are road design features that absorb the impact of collisions. They are constructed out of steel, concrete or wire. Some types of rigid crash barriers cannot absorb much of the kinetic energy of the vehicle, but keep the vehicle on the road and prevent crashing into more dangerous roadside hazards or cars from opposite direction. Crash barriers should be relatively weak with energy absorbing structures so that they can deform easily and transfer large amounts of kinetic energy to them in collisions. For barriers shielding against hazards such as trees, they need to be a fair distance away, as space is needed for it to deform. When a vehicle collides, the barriers deform and stop the vehicle through a plowing action, keeping the reaction forces relatively low. The impulse (change in momentum) is reduced, as the vehicle takes longer to slow down. The disadvantage of crash barriers is they may cause vehicle damage (crumpling) and rigid ones may deflect a car into the opposite lane. The advance of road safety The development of vehicles with greater size, power and momentum has resulted in the need for improvements in car safety devices and modern road design. The study of physics has allowed safety features in both the interior and exterior of cars to prevent large forces acting on passengers in collisions. This is why researchers and engineers are continually turning to laws of physics for advice. Road design features reduce initial velocity to reduce the risk of accidents as well as its impact on the passenger. Automotive safety companies are continuing to develop devices to improve vehicle safety, including inflatable seatbelts, 4-point seatbelts and knee airbags to name a few. With the large percentage of the population driving – forces, momentum, impulse and energy are all factors that must be controlled as our lives depend on it.

Mix Racial and Cultural Groups Are Growing in the United States Essay

Mixed Racial and Cultural Groups is increased by a marginal number in the United States. The growth of these multiracial groups started to surface through migration of different ethnics and raised most of their families in the United States even through marriage. These are some of the issues that have been raised by individual people of having an entity separation of mixed race and cultural or to considered them as Americans without a hyphen. Thinking about this issue myself, and thinking of my two children who married to a different ethnic rather than Samoans. These questions come to mind about this issue: How, Why, and what the three words that needs a big explanation about this matter. According to multiracial Americans, Americans whose identity as two or more races identifies with just one group culturally and socially. From statistics that I got from online, stated that about 2. 9% of the population in the year 2010 are self-identified as multiracial. The identity or the classification of the people’s identification is generally according to the culture they were raised in. Social segregation in many areas of the country is forming interracial unions or cultural group. The diversity of social conditions through migrations brought new groups of people to the United States. Through these migrations, mixed races started to rise when interracial marriage were born and started to increase in the United States. The movement of multiracial identity by more than one ethnicity has taken place and strong. Statistics from the year 2010 census in the United States shows that the largest multiracial groups were white and black which is 1. 8 million. The other 1. 7 millions are white and some other race, white and Asian is 1. 6, white and American Indian and Alaskan Native is 1. 4 million. I have learned that the largest growing group in multiracial is white and black which is about 134%. That is more than 1 million people. MIX RACIAL AND CULTURAL GROUP According to Susan Saulny of the New York Times, title Race Remixed, said that â€Å"sea of change is how we think about race, ethnicity and its place in society†. I believe that a challenge to trend towards multiracial from a sociological perspective is a leap that we should take. The understanding of racial and ethnic categories of their boundaries can be a problem to other multiracial groups. I think that ancestry is the biggest influence in identities through a number of generations through migrations. I also believe that each multi mix or racial group should be treated the same regardless of their identity. If they are legally citizens of the United States, they have the right to be treated equally. I believe that they have contributed to the wellbeing and welfare of the United States through their services in employment within the government, military or private companies. Regardless of the race and ethnicity, they should be treated and considered Americans. President Obama is good example of what I mean about treating them the same no matter what color of their skin or where they are from. I know that some of these mix race entities are trying to separate themselves with-in the United States but when they travel to other countries of the world, they considered be call Americans. As a citizen of New Zealand, I am proud to call myself to be an American and I respect the land that my children were born. What can the United States or these multiracial groups gain from wanting to be separated from their identity. Through my search online, I came across Mrs. Karissa Sulliva’s draft and she said that ancestry influences identities. She said that socialization is the crucible of racial and ethnic identity formation. Farley in 2002, construct racial and ethnic classifications which was adopted by the government for each race or reconsidered themselves to either refuse to identify their own race and ethnic category. MIX RACIAL AND CULTURAL GROUP. I believe that mix racial and cultural groups are increasing daily by the number throughout the United States. However, research shows that children with an original multiracial identity grow up to be happier than those of single-race identity. Some of the statistics shows that another addition to the growth of mix race is through adoption of children from countries outside of the United States. According to Fact’s for Families 2010, parents are coping with these pressures in having open communications with the families about their culture and race. Encouragement and support in every multicultural group for families to be familiar with their language, traditions and customs within their families. They have to support and try to establish a good relationship by creating a network for their children, parents, family member, relatives and the community. In conclusion, the separation and classifications between mix racial and multicultural groups is not an easy task or thing to do. Two of my children are married to different ethnic. My oldest daughter is married to an African American and my son is married to a girl who is beautiful and white but has about four or five mix blood in her. I believe in democracy and the United States is nowhere in having a separation of any mix race and cultural group who are living in the United States. Can Data Reduce Health Inequalities Health And Social Care Essay

H.O are â€Å" the conditions in which people are born, turn, populate, work and age, including the wellness system † . What is Data? Harmonizing to Webster ‘s lexicon â€Å" Data is factual information ( as measurings or statistics ) used as a footing for concluding, treatment, or computation. † Data is chiefly of two types i.e. Qualitative and Quantitative. Qualitative information is the type of informations that is non given numerically. Hence it ‘s based on people ‘s sentiment and picks. Quantitative informations on the other manus is purely based on numerical values and is subdivided into Discrete ( specific numerical values ) and a Continuous ( any numerical value ) information. Data A ; Health Inequalities: The usage of informations records for wellness of population is nil new ; the earliest survey of a entire population was done by Halley, who, by utilizing informations for the metropolis of Breslau, Germany, for 1687 to 1691, calculated the mean life anticipation at birth. [ 2 ] However it was Aaron Antonovsky, a medical sociologist, who foremost shed visible radiation on the inequality in mortality rates in 1967, which finally lead to the usage of informations to enter wellness inequalities Surveillance of inequalities now is done extensively to supervise alteration and to mensurate the indexs of wellness inequalities among the different strata of any part. With every passing twelvemonth the usage of informations to supervise and control wellness inequalities has become more and more of import. Harmonizing to the 2007 declaration of The Measurement and Evidence Knowledge Network ( MEKN ) of the WHO committee on societal determiners of wellness, â€Å" Action on the societal determiners of wellness to better overall wellness results and cut down wellness unfairnesss will be much more effectual if basic informations systems are in topographic point, nationally and internationally, and there are mechanisms to guarantee that the informations can be understood and applied to develop more effectual intercessions. † [ 3 ] The point to foreground in this declaration is that informations should be understood right and applied affectively for it to do effectual intercessions. So the inquiry is does all this collected informations can be the premier ground for alteration and cut downing wellness inequalities? The simple reply would be that natural informations itself can non convey any alteration but the determinations that are taken after treating that informations are the chief agents of alteration. Management of Datas: Datas in itself is merely a aggregation of natural Numberss or characters. The information collected has to be converted into feasible information in order for it to be utile. Here the inquiry arises what the difference is between informations and information? Beynon-Davies used the construct of a mark to separate between informations and information. Datas are symbols while information occurs when symbols are used to mention to something. [ 4 ] It is people and computing machines who collect informations and enforce forms on it. These forms are seen as information which can used to heighten cognition. [ 5 ] Thus cognition is the aggregation of information that is stored or memorized with the purpose of doing it utile. For any cognition to go utile it must be analyzed and interpreted. The procedure of understanding the cognition that we have and utilizing it to synthesise new cognition is called ‘understanding ‘ . The apprehension is converted into wisdom when we exercise our innate human nature of morality and moralss. Therefore with the aid of apprehension and the ability to judge right from incorrect the information is eventually converted into wisdom. This transition of natural informations into wisdom is called the Data-Information-Knowledge-Wisdom hierarchy. ( Fig 1 Appendix ) Another method by which information is managed is the simple informations surveillance rhythm ( Fig 2 Appendix ) . In this rhythm the collected information is analyzed and synthesized and is so organized and stored into a information base. This database so aids policy shapers to move as they deem appropriate. By the survey of informations direction it shows that the determination made at the terminal of the procedure is what determines how efficaciously information has been used and whether information has been successful in conveying about a alteration. This determination doing procedure can be influenced by ambiguity, prejudice, desire for short-cuts, resources available and shortage of attending. Any break during the informations processing rhythm can besides hold negative effects on the determination devising. Data itself has many restrictions. It depends upon truth ; if informations is non accurate it can damage a undertaking alternatively of helping it. Data should besides be complete in all respects i.e. it should supply all expected properties. The consistence of information is besides compulsory i.e. informations should be in sync across the endeavor ; sometimes informations is complete but is inaccurate and inconsistent. Data should besides be auditable i.e. it can be traced back to its beginning and can be verified for genuineness. Last, the most of import facet of informations quality is it timeliness. Datas should be fresh and up to day of the month so the steps and actions taken in response to the informations are appropriate. Examples of Data Surveillance in Curbing Health Inequalities: If we take the illustration of a developing 3rd universe state like Pakistan, so it seems as if informations can non assist cut down or alter anything. Here the inquiry arises that why should we even take the illustration of a underdeveloped state that is bound to neglect in controling inequalities? The ground for this is that Pakistan, even though being a hapless state, gets ample financess for its health care undertakings by donor administrations and other rich states. The international administrations such as WHO closely monitor the statistics of alteration in the wellness of the population of the state. So, with voluminous financess and aid from international administrations the consequence should demo an betterment in the wellness of the population, nevertheless in Pakistan ‘s instance where limited success has been achieved there has besides been failure, which proves that the regular surveillance statistics of WHO are non plenty for accomplishing success. This failure of surveillance can non be blamed wholly upon the gathered statistics but there is a complex process associated with it that plays an of import function in assisting the information be effectual. The Polio Eradication Campaign: In Pakistan the biggest illustration of the success of informations and so its subsequent failure is the national infantile paralysis obliteration thrust. Launched in 1994, 15 old ages after the planetary thrust against infantile paralysis, the infantile paralysis run started with an purpose to to the full eliminate the disease by the new century. Even after the century arrived and a decennary rolled by, Pakistan has been unable to carry through its promise of full obliteration of the disease by 2010. The run suffered from the legion alterations in authorities over clip. When it was launched, the run was fueled by a media blitz of consciousness plans and ads on Television and in newspapers. This caused the hapless, uneducated multitudes to get down accepting and swearing the authorities to let them to immunize their kids. The figure of confirmed instances of infantile paralysis based on acute flaccid palsy surveillance informations from across the state declined from 1155 instances i n 1997 to 28 in 2005 [ 6 ] – the lowest of all time recorded in one twelvemonth ( Fig 3, Appendix ) . A really sensitive nationwide describing system was built up to guarantee the sensing of all staying infantile paralysis instances. The system captures all kids aged less than 15 old ages with acute oncoming flaccid palsy, and includes subsequent research lab testing of stool specimens. [ 6 ] The success was short lived as from 2007 the figure of instances came to a standstill, but there was an addition in figure of reported instances from little territories and states where entire unsusceptibility was achieved ( Fig 4, Appendix ) . In Punjab e.g. there were no reported instances in 2007 ; nevertheless in 2008 more than 8 instances were reported. The biggest reverse to the run is due to the on-going war on panic in Pakistan. In 2008, 2009 and every bit recent as February 2010 the instances reported were all from the Federally Administered Tribal Areas ( FATA ) where the people are highly hapless and uneducated and the next state of N.W.F.P. Two new instances were reported in the past hebdomad both from North West Frontier Province ( NWFP ) , conveying the entire figure of instances for 2010 to ten [ 7 ] . The most recent instance had onset of palsy on 27 February and that excessively was reported in the N.W.F.P. The radical elements in these countries have started a smear run against the infantile paralysis thrust and have warned the people to maneuver clear from immunizing their kids. This includes snatch of the infantile paralysis run workers and warnings of dire effects to the people of the part. [ 8 ] The recent engagement of the National Database and Registration Authority ( NADRA ) in Pakistan to immunize kids against infantile paralysis has met with great success. The NADRA new waves were successful in publishing ID cards to far flung countries and as a consequence of the success the authorities entrusted them with the responsibly of providing vaccinums to remote countries. Equally many as 20,000 kids were vaccinated as a consequence but the NADRA squad was still unsuccessful in embarking to the N.W.F.P and FATA parts. The migration of Afghan nomads into the countries of FATA A ; N.W.F.P is another ground for failure. Poor sanitation and dirty H2O supply in the rural parts of the state can besides be the ground for the failure, as this causes diarrhea which in bend reduces the soaking up of the vaccinum in kids. [ 9 ] On top of these hurdlings the run is besides marred by corruptness including larceny of financess and vaccinums. [ 10 ] The National AIDS Plan: The national AIDS plan in Pakistan is one illustration of truth of informations and how any alteration can be hindered if the information is falsified. Pakistan ‘s Federal Ministry of Health established National AIDS Control Programme ( NACP ) in 1986-87. The state has received over 2.9 billion rupees as support. In its early phases, the programme focused on laboratory diagnosing of suspected HIV instances, but increasingly it began to switch its focal point towards HIV bar and control intercessions. The development of National Strategic Framework-one in 2001 provided strategic vision to the national response and authorities of Pakistan with support from World Bank launched an enhanced response in the signifier of Enhanced HIV and AIDS Control Programme. [ 11 ] HIV was foremost reported in Pakistan in 1987 with the aid contaminated blood transfusions. [ 12 ] The chief bearers of the virus were non resident workers chiefly working in the gulf part who were deported back to Pakis tan in the wake of their diagnosing. [ 13 ] The full fledged outbreak nevertheless occurred in 2004 among the injection drug users ( IDUs ) in distant desert town of Larkana. Between 2003 and 2004 the rate of HIV in IDUs jumped from 0.4 % to an dismaying 7.6 % . Epidemiologic surveies have shown that out of the 100, 00 IDUs life on the streets, about 21 % are infected with HIV virus. [ 11 ] These IDUs do non indulge in the drugs merely for the bang but alternatively comprise of the highly hapless and flush subdivision of the society who are idle and as a consequence become drug users to get away from their problems. Lahore is the 2nd most thickly settled metropolis in Pakistan with over 3000 IDUs of which 4 % have HIV infection. Faisalabad is the 3rd most thickly settled metropolis with over 8000 IDUs of which 13 % have HIV. The most alarming fact is that surveies have found that about 50 % these IDUs are sexually active with their married womans. To do affairs even worse bulk of the married womans of IDUs work as cocottes. [ 14 ] Another demographic involved with the spread of HIV are the female and male sex workers. There are good known whorehouses in the metropolitan metropoliss of the state with up to 100, 000 female sex workers ( FSW ) in Karachi and 75, 000 in Lahore. The authorities organic structures estimate that HIV prevalence among FSW is 0.02 % [ 11 ] which is disputed by independent organic structures who say that it is about 15 % . Research has shown that these FSW have no information about rubbers or other bar methods. Less than half the FSWs in Lahore and about a one-fourth in Karachi had used rubber with their last regular client. In Karachi, one in five sex workers can non acknowledge a rubber, and three-fourthss do non cognize that condoms prevent HIV ( in fact, one tierce have ne’er heard of AIDS. ( UNIADS Update 2005 ) The other demographics for the disease include closeted homosexual work forces and Transvestites moonlighting as sex workers which are estimated to be approximately 3 0 % of the manner of transmittal. Breast eating female parents are another demographic that constitutes about 3 % of the manner of transmittal of the virus. The fist instance of transportation of HIV via chest eating was reported in 1994 in Rawalpindi. Irrespective of all this data the most lurid fact is the disproof and use of the informations by the National AIDS control plan who have estimated that there are about 3,000 instances of HIV in Pakistan since 1986. If we compare these estimations to the astonishing 70-80, 000 instances reported by the UNAIDS, we clearly see that the authorities enterprises are a frontage. This estimation is flooring plenty to ensue in immediate action by the authorities but that is non the instance. In world the authorities is to the lowest degree interested in turn toing the issue of AIDS as a world in Pakistan. This may be due to the fact that the state is a conservative Muslim state and even now issues like HIV A ; AIDS are considered as tabu. In the uneducated and hapless rural sector the disease is still considered as a stigma even though there insecure and closeted sex pattern in these countries. The political determination devising in this issue seems to be influenced by the delicateness of t he issue. The policy shapers are besides bound by the civilization of the state and they can non openly publicize safe sex patterns as this may be unacceptable to the people and the policy shapers do non desire to be seen as excessively broad by the conservative vote population. In the visible radiation of all this the World Bank in December of 2009 refused to further fund the AIDS plan in the state. Decision: The above illustrations show that informations itself can merely make so much. Astonishing and amazing figures may drive person to believe about the job and take some sort of action but the magnitude of that action is dependent upon the apprehension, reading and finally determination of that individual. In the instance of the infantile paralysis consciousness run the above illustration shows that informations can be used to an advantage in doing public change their beliefs and accepting alteration. But on the other manus informations can be useless, even if it is difficult striking, if no action is taken upon it i.e. in the instance of the AIDS run. If the Pakistani authorities wants it can alter the attitude of people towards safe sex pattern via an consciousness run but they choose to stay deaf-and-dumb person on the issue. Policy shapers can utilize informations to their advantage by utilizing the figures and acquiring the populace to believe about the job. Similarly the populace can utilize informations to demand a alteration from the authorities. Not merely determination devising but other societal factors besides stand in the manner of a complete or any success. Purportedly, If the illustration of a 3rd universe state is deemed unequal by person so we can ever take the illustration of Britain where there are beforehand methods of informations surveillance and a immense sum of research and money is being used to control wellness inequalities but a recent authorities study showed that the rates of indexs like life anticipation for adult females and infant mortality are still unchanged. This has prompted the wellness minster Dawn Primarolo to eventually acknowledge, in stead with our statement, that â€Å" wellness inequalities are hard to alter † . Appendix: Fig 1: DIKW Hierarchy Fig 2: Surveillance Cycle Fig 3: Graph 1 ( diminution of infantile paralysis over the old ages ) Fig 4: Graph 2 ( diminution and revival of infantile paralysis in little territories of Pakistan ) Can Data Reduce Health Inequalities Health And Social Care Essay H.O are â€Å" the conditions in which people are born, turn, populate, work and age, including the wellness system † . Appendix: Fig 1: DIKW Hierarchy Fig 2: Surveillance Cycle Fig 3: Graph 1 ( diminution of infantile paralysis over the old ages ) Fig 4: Graph 2 ( diminution and revival of infantile paralysis in little territories of Pakistan )

Media Audiences - Essay Example There is also the importance to differentiate between mass audiences that are broadcast to and the niche audiences involved in narrowcasting. In terms of subjectivity, there is the impact on the audience members by the membership of the pre-existing group including gender, religion, education and nation. It may also be defined in regard to a mainstream audience for the narrowcast media. This imagined mainstream is what elite and sub-cultural forms do define them. It is a socially constructed phenomena. In contrast to the critique of mass society, the culture of mainstream is not addressed to an audience that is homogenized as it is diverse and made of different multiple audiences that come from various demographic groups whose mode of engagement might have. This makes it appealing and also commercially lucrative. It may be hard to define, and its meaning normally shifts in accordance to its usage. Appreciating mass audiences will offer that opportunity of resisting adoption of the media’s terms as our own. Audience size together with commercial profitability is construction factors in mainstreaming though it should be understood independently. Though mainstream media are known as an object of passionate feelings, it is what that moves most of consumers to participation (Newma n, 1). Mass audience as included in the definition for the mass communication has distinguishing factors that include: it is heterogeneous in composition, composition of individuals is that of those who do not know each other, members of the mass are spatially separated, and the mass has a loose organization and leadership that is not definite (Napoli, 7). The new mass audience considers the mass audience as both the receiver and the sender of the message. An economist Dalls Smythe 1977 stated that the act of consuming media included a form of labour that is wageless engaged by

Values and Ethics in Professional Business Term Paper

Values and Ethics in Professional Business - Term Paper Example This makes the smooth functioning and sustained endurance of the business organizations quite certain. Fresh inclinations and concerns which occur on a regular basis are capable enough of giving rise to a significant trouble for the organizations and even for the end-customers. The environment of business has been undergoing a constant alteration which is giving birth to various complexities with regard to the business organizations (International Trade Administration, 2004). In the recent times, owing to the intricacies involved with businesses it has become necessary and vital for the organizations to indulge in appropriate ethical behavior and to maintain certain values for the reason of staying away from probable lawsuits. The public disgraces of the corporate unethical and malpractices have created an adverse influence on the viewpoint of the general people towards numerous organizations like Arthur Andersen, Enron, Union Carbide and WorldCom (Mahdavi, 2005). The Need for Values & Ethics in Professional Business Compromising with the values and indulging in unethical behavior have led to the collapse of quite a few organizations. In the present day’s context, the business organizations are anticipated to comply with the standards regarding carrying out of the business in a responsible way. The expected standards surpass the ones that were followed traditionally. Although, the concept of business is frequently referred to on the basis of profits, productions and jobs but at the same time, it is comprehended and acknowledged worldwide that a particular business enterprise continues to be an associate of the community it is operating in. The hunt for profit followed by economic development is not being considered to be a permit for disregarding the standards of the community norms, respect, quality, integrity along with the values with regard to the business organizations (Weiss, 2008). Profit is measured to be the most important factor for the busines s enterprises. Enhanced business performance, economic development and profits have been found to be attained by those who efficiently and competently promote and meet up to the rational beliefs of their respective primary stakeholders. The stakeholders entail employees, investors, customers, environment and suppliers along with managers as well as owners. The factor of success with regard to any kind of a business is in due course gauged and ascertained in terms of profits as well as losses. The socially dependable businesses have been learnt to create the proceeds and the capitals that is supposed to be necessary to continue the business functions and to ensure existence in the long-term with the help of taking into concern the beliefs of the stakeholders. The businesses that are conducted in a socially responsible manner have been identified to be successful in creating and making sufficient income for meeting up to the actual ‘cost of capital’, the doubts as well as risks related to the economic procedures that are predicted to arise in the coming days along with the necessity of the employees and the pensioners. However, the businesses that are considered to be socially irresponsible remain unsuccessful in meeting up to the mentioned expenses as the reasonable requirements of the stakeholders are not met by such businesses. For instance, a proficient, effectual and dependable business organization would earn income or profit by fulfilling the necessities of its customers. It would lure capital with the help of meeting up to the prospects of the different investors. It further augments its effectiveness with the help of luring employees with superior competencies. It trims down the expenses by bringing

Construction law essay and legal problem case Example | Topics and Well Written Essays - 3500 words

Construction law and legal problem case - Essay Example The leading decision in this area is British Steel Corporation v Cleveland Bridge & Engineering Co Limited3where it was held that that where work was undertaken pursuant to a letter of intent, in most cases it would not matter whether the formal contract was concluded. If the parties had acted on the letter of intent, then payments claim would due on a quantum meruit basis under restitution4. However, the inherent difficulty with a letter of intent is where a party is seeking to claim damages for breach of contract and it is argued that no contract is entered into. Accordingly, the issue of whether a contract is in existence is vital. Moreover, if there is no contract, it begs the question as to what sums the CCL is entitled to under quantum meruit principles. In British Steel, it was held that the letter of intent covered pre-contractual negotiations and as no terms had actually been agreed, there was no binding contract. Therefore, the extent to which a contractor can rely on the letter of intent to enforce their rights will inherently be dependent on what terms are agreed to in the letter of intent itself. In the British Steel case for example, it was evident that issues pertaining to price, delivery dates and the applicable terms and conditions had not been agreed. As such, the Court concluded that there was simply an obligation upon Cleveland to pay a reasonable sum for such work as had been done pursuant to its request contained in the letter of intent on a quantum meruit basis. The general rule as highlighted in Turriff Construction Limited v Regalia Knitting Mills5 is that a letter of intent will be of no contractual effect and that a letter of intent is â€Å"no more than an expression in writing of a party’s intention to enter into a contract at a future date. Save in exceptional circumstances, it can have

Socio-cultural Influences on Sexuality Research Paper

Socio-cultural Influences on Sexuality - Research Paper Example or, gender identity and roles and gender stereotyping and bais are majorly influenced by social and cultural issues as demonstrated by divergent perceptions and approaches across different socio-cultural settings. Different societies have cultures that have been nurtured over a long time that influence the perception of the members with regard to sexuality issues. The paper looks at the various perspectives in which socio-cultural issues influence perception with regard to sexuality. Debates surrounding sexual orientation and accomodation of same sex partners in most societies are usually influenced by the socio-cultural provisions with regard to such unions. The catholic church, most African and Arab countries have strongly expressed their opposition towards such unions. The common attribute of the catholic church, most African and Arab countries is that sexuality is not usually a subject that I spoken openly and even with the existence of gays and lesbians, these societies go at great lengths to condemn such unions. According to Worrel (2003), these socities are characterized by the existence of socio-cultural norms nurtured over long periods of time and no opposition to these norms is usually welcome. Worrel continues to outline that in more democratic societies in the western world and other developed countries, gays and lesbians are being given a chance to fight for recognition in the society. Gender roles and identity are aspects that are nurtured at a avery young that by the time children grow to become adults they already have solid perceptions towards these issues. The traditional set up where the man was supposed to provide for the family while the woman stayed at home to take care of children is still a major concern for gender equality activists. Even with the changing society where socio-economic developments have made it necessary for the woman to work to supplement the earnings of the man, the society still finds it difficult to embrace the change.

Social injustice Essay Example for Free

Social injustice Essay We’ve all applied to a job and didn’t get it. Did you ever think to yourself it was some type of discrimination? Social and racial discriminations happen all the time in the workplace. You may be turned down from a job because of your race, social status, or even your gender. Many times in the workplace people are deemed unfit for the position, but why? Why should it matter if you’re a female or male for certain jobs positions? Who says a male cant preform the job to potential as a female or visa versa? If you walk into a Claire’s, per say, it will be all women working there and I’m sure when males walk in they feel discriminated to ask for an application because all they see is females working in there; It’s a double standard contraception. However, it’s how society implies how or what kind of roles the male or female should contribute to the work environment. I for one have thought of applying for a certain job that society would not †expect† a young man to partake in, so sadly knowing I would have fulfilled the job exceptionally suitable did not take it because I cared about what other people thought of. Race is one of the biggest struggles for many perfectly applicable people who would fulfill the desired job they want to apply for. One of the most sensitive subjects that have been around for decades would be peoples race. I have two close friends, whom are extremely hard working, book smart, and have great social skills who applied for a high end job down south after college. They were turned down =, and for what? What color they were? This is one of the biggest disappointments our society still has to deal with to this day. Perfectly adequate young men or women could perform any job they believe and work hard for and they should NEVER be turned down for their race. Because who would know if that certain raced man or woman would have executed that job better than lets say the white raced man or woman? The way people look is another example of a high social injustice situation. The â€Å" benefit of the doubt† is the proper mindset of what every interviewer should have. Say a man comes into an interview with tattoos and wearing jeans and a dirty button up, yes, they look like they don’t care but that’s all they can afford to look like until they are hired and get a job. Vs. a man who comes in tight suit, brief case and put together. The man with the tattoos is a hard workingman and has all the exceptional social skills they need to fulfill the job, and the man in the suit is only book smart and has no patience to work with people. The interviewer picks the man with the suit because he looks more †suitable† for the job. That is not acceptable. The other man would no doubt work extremely hard to make sure he executed his job to the highest standards. But what our society and the work place wants is who will be the fresh face that is the face for the company. The â€Å"benefit of the doubt† is dying in these kinds of situations because our society these days expects a certain kind of person to be dealing with customers and when doing so, look a †certain† way. I’m sorry but our society these days, is just not right. And we all need to start giving the benefit of the doubt and know what the real â€Å"face of the company is†. All these examples of Social Injustice are what real people are living through/with every day of their lives and its man vs. society when they deal with these situations. It’s just not right that there are people out there who think its acceptable to turn down adequate males or females who could perform a job better than people they hire whom they think they can. And if there is a day that it happens to myself I will stick up for myself and prove that person wrong because all the people who have been turned down know what they are capable of and its not fair they don’t get the chance to show what they can do.

Computerized Cognitive and Psychomotor Battery

Computerized Cognitive and Psychomotor Battery The primary goal of this study was to develop and validate the computerized cognitive and psychomotor battery for the sharp shooters. In order to construct the test, task analysis were carried out. For the experts in the field of psychology, experienced shooters and coaches were interviewed in the army marksmanship training center. Based on that skills and abilities required for the shooters were identified. In order to quantify those skills eight tests were identified i.e. Reasoning, visualization, shifting of attention, simple reaction time, complex reaction time, sustained attention, Eye- Hand Co-ordination and mental stamina (to with stand the match pressure). Initially the test protocols and requirement were developed and those were discussed with the software experts. The software professionals prepared the test software by using OPENGL and MYSQL software packages. After computerized the battery, validation process were started. In order to establish the psychometric properties , the study has carried out in two phase. In the first part of the research was focused on the validation of cognitive and psychomotor battery and in the second part validation of self reported mental toughness scale. In order to establish the psychometric properties of perceptual and motor battery around 650 samples were collected from shooters in IMA and Army Marksmanship unit. To establish the reliability, test retest method employed to investigate the temporal stability, for this 45 shooters were collected from Army marksmanship Unit (8 months’ time interval) (Mean age 24.2 SD 3.8 Average year of experience in shooting 3.5) .Overall the correlation was moderate, the lowest value was obtained in simple reaction time (See table No).For rests of the scales temporal consistency was moderate level. Apart from that pair sample t tests used to check the consistency of the score in the two levels. There was no significant difference between the mean test and retest scores mean scores. This findings supports the test battery is maintaining adequate temporal consistency. To study the factorial validity, exploratory factor analysis was carried out. Findings shows that three factor were emerged and it explains 60.2 %. In factor I reasoning and perceptual style test is loaded (), Factor II Vigilance, Eye hand Coordination and shifting of attention is loaded and in Factor 3 simple and choice reaction time is loaded (). The tests loaded on factor I, it measures logical reasoning and decision making of an indivual, and both the tests are non verbal matrix test, which may be the cause of loading both the test in Factor I.In the second factor, Sustained attention Shifting of attention and Eye hand Coordination are loaded, theoretically it was not expected the psychomotor test shared common variance with the test that measures attention and concentration. In the Eye hand coordination test subject has to focus and move the ball with the help of the Joystick, and to perform the task the subject is not only required psychomotor skills but the subject has to conc entrate and focused the task, which may be the cause of loading this test in Factor II.In the Factor III, the tests measures the psychomotor skills (simple and Choice reaction time) are loaded. To cross validate the latent structure emerged in the exploratory analysis, a separate confirmatory factor analysis were carried. Two competing models were developed but the results shows that the three dimensional oblique model is adequately fitting the data. After factorial validity, to establish the predictive validity of cognitive and psychomotor battery, separate set of data were collected from the participants of talent shooting competition and shooters performance appraisal data from the training institute. And to establish the validity, t-test and discriminant analysis were carried out to predict how far the battery is predicting the performance of the shooters. In the talent shooting competition around 415 IMA cadets were participated in the shooting competition, in this only 397 cadets were under gone cognitive and psychomotor battery. After competition only 17 cadets were recommended for shooter sport. Results of the analysis reveals shows that there is a significant difference between the recommended and non recommended shooters in cognitive and psychomotor skills. Particularly reasoning ability, spatial visualization, handy steadiness, reaction time and sustained attention of recommended shooters (N=17) significantly different from than the below non recommended shooters and this indicated that they are better in cognitive and psychomotor abilities (except divided attention) than non-recommended shooters. To further validate the battery, performance appraisal reports were received. Trainer and coaches assessed the shooters, based on the performance in the national and international competitions, based on those shooters were rated as below average and above average shooters. Data were collected from 50 experienced shooters; finally 36 pistol shooters (mean age 23.1 and SD 3.25) reports were received for validation, in these 11 shooters were rated as below average and 25 shooters as above average shooters. Results shows that above average shooters are better in sustained attention and handsteadyness. In the discriminant analysis, both the variables explain 25.4% of the variation in the dependent variable and it correctly classify 75 % of respondents into ‘Above average’ or ‘below average shooters. Overall predictive accuracy of the discriminant function is called the ‘hit ratio’. Non Recommended shooters were classified with slightly better accuracy (76%) than recommended shooters (72.7 %). Overall the cognitive and Psychomotor test are significantly predicting the performance of the shooters. Particularly in the novice shooters, parameters related to perceptual style, choice reaction time and handsteadyness play a major factor for predicting the performance. These parameters (except handsteadyness) are measuring the constructs related to logical reasoning and decision making. It may be due the participants are not skilled shooters they are novice, while shooting they required more cognitive resources, because they are in the learning phase. But in the skilled shooters (experienced shooters) sustained attention and Eye hand coordination is significantly predicting performance. Basically these constructs are measuring the alertness and psychomotor coordination, this may be due to the shooters are experienced and they are in the automatic phase, so they are not required much cognitive resources to perform the task. Findings of this study partially support the Ackermanâ₠¬â„¢s theory of skill development. According to Ackerman’s (1988) theory of skill development predicts differential relations of cognitive and psychomotor to different phases of skill development. When participants are learning the task, cognitive variables should have a higher impact on performance than psychomotor variables, with the opposite relation when participants are in the practice phase. Further to explore is there any difference between the different categories of shooters in cognitive and psychomotor abilities. For this, test were administered to slow and rapid shooters, in this category particularly trap and skeet shooters has to hit the fast moving target in the different direction, for this task, the shooter has to be extra cautious, proper Psychomotor coordination and quick reaction time is required, but the findings of the study shows that the rapid shooters mean score of shifting of attention, handsteadyness and reaction time is slightly better than the slow shooters, but it’s not statistically significant. As a part of this research ,to explore how training and experience in shooting competition improves on perceptual and motor skills, in order to answer this question , newly inducted (less than five years ) and experienced shooters (more than five years ) were identified and administered the psychomotor battery. Results show that there is no statistically significant difference between the groups in the cognitive and psychomotor abilities. It revealed that training, exposure and experience in shooting are not improved much in cognitive and psychomotor skills. From this we can infer that, if the skills are not improved much in training and experience, better it can be identified in the induction level to make successful shooters, but further in-depth longitudinal study has to be carried out to support this finding. Overall the validation study reveals that cognitive and psychomotor skills are significantly contributing for shooting performance. Apart from the cognitive Psycho-motor abilities, emotional component plays a vital role in shooting sports performance. He/she may be technically competent and innate aptitude for shooting but if he is not able to control the emotion and with stand the match pressure, he/she will lose the game. The next part of the research is focused on the construct of mental toughness. Although mental toughness is a broad term that has been associated with a variety of mental skills, little has been done to quantify mental toughness for research and assessment purposes. The current study is conceptually based on the available literature and previous concepts believed to be related to mental toughness. The next part describes the method used to establish a mental toughness questionnaire The second part of the research focused on development and validation of Mental Toughness Questionnaire (MTQ), for that available literature and concepts to be related to mental toughness were explored, based on that initially 120 items were generated, subsequently which were reduced to 100 items based on expert opinion. Consequently, the same was subjected to items analysis (item total correlation and factor loading) and it finally reduced to 40 items. Further to explore whether the mental toughness scale is uni-dimensional or multidimensional in nature, and to study the latent structure of the questionnaire, principal component factor analysis was employed. In the factor analysis, three factors were emerged and it’s explained 45.4 % of variance and it termed as self confident, self control and resilience and to cross validate the latent structural model, confirmatory factor analysis was carried out ,which rejected the alternative models ( uni-dimensional three dimensional orthogonal and second order factor model) and supported the three dimensional oblique model. In order to establish the reliability of the tool, Test retest reliability (r = 0.635) and internal consistency reliability (r = 0.912) was established. Apart from the face and content validity and to establish criterion validity, concurrent, construct and predictive validity were identified. In the concurrent validity the mental toughness tool is significantly correlated (0.683**) with the existing mental toughness scale and to establish the construct validity both convergent and divergent validity were established. In the convergent validity it is related with the theoretically relevant constructs (i.e. Resilience, Hardiness, neuroticism and positive Negative affectivity) and for divergent validity it’s not correlated with the theoretically irrelevant constructs. Further to identify how far the mental toughness scale is predicting the efficiency of the shooters performance. For this predictive validity is established with the following criteria’s i.e. Expert Novice shooters, shooting score in the competition and successful unsuccessful shooters in the competition. In order to establish the predictive validity, the tests were administered to the expert and novice shooters. Finding shows that mean mental toughness score for expert shooters (M = 174 SD =?) was significantly different from Novice shooters (M=162, SD=.54) and indicated that Expert shooters being more mentally tough than Novice (t = -5.666, df = 279.4p Apart from that, further analysis carried out to identify how far the mental toughness scale is predicting the shooting performance, for that the MTs score has correlated with the shooting score. Findings show that both the variables are significantly positively correlated and in the stepwise regression, mental toughness factor I (Self confident) explains 4.6% variance in shooting score. Martin and Gill (1991) found self-confidence to be significantly and positively related to distance running performance, but found no significant relationship between cognitive anxiety and running performance. Similarly Hardy (1996b) and Parfitt and Pates (1999) found that self-confidence accounted for a significant proportion of performance variance over and above that accounted for by cognitive anxiety Analyses of variance revealed that mean mental toughness score of Successful shooters (Medal recipient) is significantly higher than the average and below average performers. In order to see whether is there any influence of age, gender and experience of shooter is related with mental toughness. Adams Nicholls et.al. (2009) reported that there is a significant relationship between mental toughness and gender, age and sporting experience. According to age, evidence from developmental sports psychology research found young and old adults differ in their self perception social influence motivation and self regulation with regard to sports participation (Weiss 2004).Therefore the role of development factors such as age could influence the mental toughness. Findings of the results showed that there is a significant relationship with age and mental toughness (0.243*). In particular, it appears that when people get older they improve in overall mental toughness, and more specifically in their levels of commitment, emotional control and life control. These findings have significant implications for the development of mental toughness. Clough et al. (2002) have suggested that mental toughness is a trait-like personality characteristic, and Golby and Sheard (2004) have suggested genetic links. But, our findings suggest that life experience may well be an important factor in determining mental toughness levels. In respect of competitive experience, Connaughton Waedey, Hanton and Jones (2008) reported that competitive experience was a crucial factor in the development of mental toughness among athletes. The result of the study shows that there is no significant relation between the shooting experience and mental toughness. It reveals that the training imparted for the shooters and the experience they gained from the shooting exposer is not significantly improved the mental toughness. Age and years of experience are of course closely related variables (r = .79 in this study). Therefore learning experiences and/or biological changes might be responsible for the small changes in the attributes underlying mental toughness. In order to further study whether the shooting experience is improving the mental toughness or not ,a small longttitunel study was conducted to check whether is there any changes in mental toughness after induction in to training and the participation in national and internati onal events. Around 20 participants samples were selected and administer the test during the Young blood competition, in these only 11 participants were selected and inducted for training in Army marksmanship unit. After that participants undergone training and participated competitions, one year after again the MTS data collected from the same candidates to check there is any improvement in MT’s, findings revealed the mean mental toughness score is improved slightly after undergone training and participation in competitions but it’s not statistically significant. Further exploratory analyses examined the relationship between gender and mental toughness. But the result of the study shows that, no gender differences were found on the scale, but previous studies (Nicholls et al., 2009; Findlay Bowker, 2009) suggest that males would have higher mental toughness than females. Social desirability is the tendency for individuals to portray themselves in generally favorable light. Edwards (1957) defined the construct as a tendency to provide socially desirable responses to statements in self-description. Marlowe Crowne (1960) defined it as a tendency to give culturally sanctioned and approved responses. Jackson (1984) saw it as a tendency to describe oneself in terms judged as desirable and to present oneself favorably. These definitions indicate a style of responding that is separate from the specific personality content dimension to be measured by a psychological test. A potential problem for a self-report personality scale is whether an elevated score represents a high score on the test’s content dimension or a tendency to present oneself favorably. Various methods exist for coping with social desirability in self-report inventories. First, a forced-choice format could be used for the test. Response options for any test item would then be matched for social desirability. Second, test items could be selected for a scale based on those items being more strongly representative of the psychological construct of interest than social desirability. Third, test instructions could be tailored to reduce the likelihood that test takers will respond in terms of social desirability. Fourth, social desirability could be statistically removed from the score generated on the test. Fifth, the questionnaires under investigation are correlated with a Social Desirability Scale and consequently demonstrating that the questionnaires under investigation do not correlate with the social desirability scale or if they do, that the correlations of these questionnaires with other variables of interest are not significantly attenuated when scores from Social Desirability Scale are partialled out ( Mummendey, 1981). To identify the social desirability of this tool the 40 items of the newly constructed Mental toughness scale was administered with the Soci al Desirability Scale – 17 (Strà ¶ber, 1991) on a sample of 281. The Social Desirability Scale – 17 was developed because some items the Marlowe-Crowne Scale was found to be inapplicable to the present day. The scale has high reliability (ÃŽ ± = .80). It shows a convergent correlation of r = .68 with the Marlowe-Crowne Scale. The correlation between the two test was found to be statistically significant (r = -.001). Finally, the MTS score was positively correlated(r=0.29, p>.001) with the SDS-17 Score. However its magnitude was relatively small with social desirability accounted for only 7.5% of scale variance. This finding suggests that mental toughness assessment and training may prove valuable in enhancing performance and retention of the shooters

A Perfect Day for Bananafish :: Perfect Day Bananafish

A Perfect Day for Bananafish Picture walking into a hotel room and finding a man dead on a bed. Upon closer inspection it becomes obvious that he has supposedly taken his own life with the gun that lay beside him. In talking to his wife who was asleep on the bed next to him when this incident occurred, it is learned that he just walked in the door and shot himself late the previous night. Out of the many questions that could be asked from this story, I believe that it is probably extremely important to consider why the main character, Seymour Glass, decided to commit suicide. What I believe to be the reason for Seymour’s suicide has two basic components: the spiritual depravity of the world around him, and his struggle with his own spiritual shortcomings. The spiritual problem of the outside world is mostly a matter of material greed, especially in the west, and materialism. On the other hand, his own spiritual problem is more a matter of intellectual greed and true spiritualism. In addressing the suicide, the difference should be distinguished between the "See More Glass" that we see through little Sybil’s eyes, and the Seymour Glass that we see through the eyes of the adult world. Even though these two characters are in theory the same man, they are slightly different in some ways. You could also say that they are the same character in different stages of development. Whatever the case may be, the "reasons" for the suicide shift slightly in emphasis as the character changes. "A Perfect Day for Bananafish" attempts to symbolize that the bananas in See More Glass’s story represent all of the things which are taken in along the journey to adulthood. If pursued with too much zeal, these bananas can prevent spiritual development and lead to a greater materialistic development. See-More has realized that he cannot get rid of enough bananas to make any further spiritual progress in this life, so, rather than waste time, he commits suicide. This is slightly obvious when he is taking the elevator back up to his room on the night of the suicide. His fixation upon his feet, which do not resemble the childlike feet that he desires to have, and the woman in the elevator’s scorn towards Seymour’s accusing her of staring at his feet, drive him to dislike the adult world even more.

Mary Shelleys Frankenstein and John Miltons Paradise Lost Essay

Mary Shelley's Frankenstein and John Milton's Paradise Lost â€Å"Forth reaching to the Fruit, She pluck’d, she eat:/ Earth felt the wound, and Nature from her seat/ Sighing through all her Works gave signs of woe,/ That all was lost [†¦]† (PL 8. 781-784) In the gothic novel Frankenstein, Mary Shelley weaves an intricate web of allusions through her characters’ expedient desires for knowledge. Both the actions of Frankenstein, as well as his monster allude to John Milton’s Paradise Lost. Book eight of Milton’s story relates the tale of Satan’s temptation and Eve’s fateful hunger for knowledge. The infamous Fall of Adam and Eve introduced the knowledge of good and evil into a previously pristine world. With one swift motion sin was birthed, and the perfection of the earth was swept away, leaving pain and malevolence in its wake. The troubles of Victor Frankenstein begin with his quest for knowledge, and end where all end: death. The characters in Frankenstein are a conglomeration of those in Paradise Lost. Frankenstein parallels Adam and Eve in the Garden of Eden, as well as God, while his monster acts an Eve/Satan mixture. The most predominant theme of this novel is the characters’ ever-present search for knowledge. It is this thirst for learning that spurs Frankenstein’s psychotic attempts to give life to inanimate tissue, ultimately causing his demise. Frankenstein, in this way, mirrors the character of Eve in Paradise Lost. Eve lives her most peaceful life in the Garden of Eden, her only job being to tend the plants in the Garden which she loves so much. In the novel Frankenstein, Frankenstein lives in an Eden of his own, though macabre in nature. His â€Å"garden of life† is actually mo... ...was influenced greatly by Milton’s work, evidence of which lies in the eerie similarities between the two. The allusions to Paradise Lost give the reader a story by which to subconsciously compare the characters of Frankenstein, thus also reiterating one of the main themes; the quest for knowledge and the resultant death. Following the death of Frankenstein, his monster utters his own last words. â€Å"‘But soon,’ he cried, [†¦] ‘I shall die. [†¦] I shall ascend my funeral pyre triumphantly, and exult in the agony of torturing flames’† (225). Works Cited Milton, John. Paradise Lost. 1667. The Debate Over Roe v. Wade :: abortion argumentative persuasive argument

The Debate Over Roe v. Wade Many critics of the Roe v Wade resolution dispute that the Supreme Court's decision was mistaken because, as said by Robert Bork, "the right to abort, whatever one thinks of it, is not to be found in the Constitution". Consequently, they say the court did not translate the Constitution at all in making their influential mark on the citizens of the United States. Ronald Dworkin, on the other hand holds a different perspective of this situation. He tends to believe that although the technical terminology of abortion was not stated in the Constitution, the simple right of privacy, which in his mentality, deals with termination of a pregnancy. Some critics of the decision regarding Roe v Wade feel that the court is, in a sense, legalizing murder. Most refined critics on the other hand believe that the Court's decision on this issue was indeed wrong, but for different reasons. Like Bork, many feel that the Court had no right to interpret the binding piece of our country, the Constitution. Since the word "abortion" is not used in the Constitution, right-wing lawyer Bork states " Unfortunately, in the entire opinion there is not one line of explanation, not one sentence that qualifies as a legal argument ". (pg, 103, Bork) He continues to say " It is unlikely that it ever will, because the right to abort, whatever one thinks of it, is not found in the Constitution ". (Pg, 103, Bork) Dworkin, distinguished author of the book titled Life's Dominion, feels differently than the critics described above. He deems that the court does in fact have the right to interpret the Constitution. Dworkin agrees with Justice Blackmun's opinion in this great philosophical issue. Blackmun feels that " a pregnant woman has a specific constitutional right to privacy in matters of procreation, and that this general right includes a right to an abortion if she and her doctor decide upon it". (pg. 105, Blackmun) In 1965, another case regarding the right of privacy made a lasting and influential mark as well. In Griswold v. Connecticut the Court decided that a state does not have the right to prohibit the sale of contraceptives.

Ethical Responsibilities of Corporations Enron’s Downfall Essay

Ethical Responsibilities of Corporations; Enron’s Downfall Introduction            Enron, in the 1990’s was a premium company that had the much-coveted global stature that most company heads desire. It is considered the most innovative company in the United States of America. It was a change from the old industrial trend that other old and rusty enterprises and industries were used to; hard assets, in the favor of the much softer e-commerce business world. The company was a premium employer in the USA and the world, employing over 20,000 staff by the time of winding into bankruptcy, in 2001 (NPR). The company dealt in natural gas, electricity, pulp and paper and communication. A year before closure, the company was valued at $111 billion and had held the title-for six years running-of the most innovative company in America.            However, this valuation respect was based on falsehood. The company was discovered to have been operating a scandalous accounting fraud, orchestrated by systematic, institutionalized and creativity. Ironically, as it was named the most innovative company, which might have been true, but not in the upright way that it was perceived to be. This was but in underhand deals that its employees and management had mastered. What culminated into the ‘Enron Scandal’ has since become a frequently referred to a case of willful corruption and corporate fraud.            Companies and corporations, under the federal law, have a duty to their employees, consumers, the government and the environment in which they operate. To the government, corporations are supposed to ensure tax compliance and safety of production to citizens and environment. The firms and companies have a duty to protect their employees and provide safe work environment conditions for them so that all employees are always treated equitably and satisfactorily. Consumers have a right to accurate information regarding the products they purchase. The information is to provide at free will and is to guarantee consumer safety.            In Line with that responsibility as stated in the paragraph above, Enron management failed to safeguard their employees’ future and livelihoods in case their bubble burst. At the time Enron went bankrupt, Thousands of employees it had in its baskets were plunged into joblessness suddenly. This scandal involved even top government officials who were then shareholders. In the light of them knowing that Enron engaged in malpractices-they still were happy to take home the hefty dividends they got from the stock market gains. The Times Magazine talks about the top executives who enjoyed lots of privileges that even top CEOs envied. For example, Kenneth Lay, the Former Enron Chairman is said to have received a golden parachute worth $25 million and about $200 million in salaries since 1999 to its point of fall. Despite all that, he also enjoyed the access to about $7.5 million revolving credit line from Enron (Roston, 2002). Others who enjoyed such benefits include Jeffrey Skilling (former C.E.O), Duncan David (Former Anderson Partner), Nancy Temple (Anderson Lawyer), Thomas White (Secretary of the Army), and Sherron Watkins ( Former Enron Vice President). The government through the law has set up different commissions to ensure that these obligations are duly followed (example of one is the Federal Trade Commission (FTC)). FTC is charged with taking complaints about false business promises that turn out fraudulent, or cause harmful side effects to the consumers and forwarding them to investigation agencies for further action (Federal Trade Commission, 2014).            In the past, the things that brought down companies were far from cleverly crafted schemes such as what took place at Enron. The operation on the stock exchange while on a negative financial record and receiving probably more than their fair share of investments. Among other key ethical issues that had arisen in the past included racial profiling, product safety concerns, employee rights infringement and even environmental degradation. There have been lists each year of companies that should be shunned for disregard of ethics. For the past few years, companies such as ExxonMobil, Apple, Toyota, Trafigura, and recently Wal-Mart and Nestle had made headlines for breaking the crucial ethical rules.            The Federal Employees’ Compensation Act (FECA), establishes mechanisms for compensation of employees who are injured, or get any damages in the line of duty (Office of the Secretary, 2014). In the case where an employee was hit by a truck and laid off without compensation, is very inhumane act of the company’s executives.            The Fair Labor Standards Act (FLSA) is set to be the benchmark for equitable pay distribution to all American employees. It provides guidelines for employment and wages to be paid to employees who are not exempted from work. Conditions have been set for certain jobs and age restrictions. These labor laws, for example, require that particular groups of people not work at certain times, and in particular professions, citing dangerous operations (Office of the Secretary, 2014). If the labor laws are followed to the letter, no employee will complain about unsatisfactory pay, as the minimum wage is set with all employees in mind and ensures a comfortable life away from welfare.            Kirk O. Hanson, a university professor at the University of Santa Clara, explains the ethical responsibilities of a corporate board. He lists five important points that are to be keenly upheld by any board of directors in order to ensure satisfaction from all quarters. Among other key assignments on a board, one of them is to understand the company’s ethical culture. Most board members are less involved with the day to day activities of their businesses, and to get feedback from employees, they rely on pro forma reports and complaint letters. It is their responsibility to investigate the validity of the reports and come up with disciplinary measures if need be (Hanson, 2014).            Business fair play is an important aspect of ensuring healthy and profitable competition among business people.            Such a supposition that they respect individual rights of association and expression and yet reject the idea of unionization is ridiculous. Under sections 7 and 8 of the National Labor Relations Act of the Federal constitution, employees are granted rights to make a join and take part in labor union activities. This is without any intimidation from employers, or punishments of any kind. All employees have a right to read, distribute and discuss matters of union membership during hours away from work. They are free to share the information with whomsoever they please. Once they decide on a group plan for whatever union, they have a right to ask their employer to recognize the specific union, bargain and complete any relevant requirements by the terms and condition. The employees have a right to display Union messages in whatsoever manner they please; be it caps, pins, T-shirts or whatever else available on the job or away from work.Company executives are not suppose d to profile any employees by forcible transfer, denial of benefits, pay rise or desirable assignments in effort to thwart employees’ quest to join or form a union. They are not to be harassed, threatened or dismissed from work if they support any union (Lisa Guerin, 2014). All in all, we do need quick solutions to problems such as these. It is not just an issue for the employees alone because it affects all American citizens, and per the house committee on education report.            General Electric, a company that was founded by Thomas Edison, has on many occasions received accused on several occasions of trying to monopolize the inventions by him. It is the current military contractor for war machinery. However, they have once been reported for facilitating the development of nuclear weapons. Nuclear weapons have long since been banned and are regulated by the international bodies. The purpose of such an undertaking should be investigated, and due punishment administered.            The American public should check indicators of unethical codes of conduct and shun such businesses. It will be a significant boost in fighting such a vice as it will prevent oppression of fellow citizens. If people followed such a trend, companies such as this would lack a ready market and might be forced to change the practices or close shop.            All firms that are established in corporate agreements uphold certain fundamental duties. In order to solve this massive crisis of ethics, law should be passed forcing private sectors to publish their financial reports in detail in the public dailies. The public should be trained to watch for companies that uphold employee rights and safety. These statements should be audited by government agencies for any lies. If the reports are found to be untrue, government should snatch such operators their licenses.            Companies and corporations that evade taxation of any kind should be imposed with huge fines. In order to shun such practices, and in extension, be barred from operating for a particular period of time and board members is investigated. If any allegations of misconduct are proven right, all board members should be forced to resign and take responsibility for their ineptness. Enron was a culprit in this category, avoiding any financial obligation it would have to offset to the government or anyone, provided that it was able to cover its tracks well.            On an opinion proposed from the Financial Times magazine, the graph of performance shows that the downfall was carefully planned. It seemed that most of the top echelons had long planned the exit, but it did not happen in the most expected way. The stock price came crashing in a year, from a cost of about $80 in January, the year 2001 to a tumbling zero by January in the year 2002.            In the Film Enron: The Smartest Guys in the Room (Gibney, 2005), as based on the same name written by Bethany McLean, the Enron Disaster is the greatest disaster any company has witnessed in the whole of history. A crash in a year with more than seven corporate walking away from the mess with over 1 Billion US dollars. Investors and employees went down flat without any landing gear. This kind of corporate ethics gap left more Americans depending on the public for necessary handouts and relying on other meager means to survive. The Drama resembles a Greek tragedy and a show of the domino effect that could shape the face of the American ethical code and ultimately the economy for a long time into the future.Kenneth Lay, the company’s chief who had saved ib once before in the ‘80s and later taken over as C.E.O wielded so much influence In both the business and political circles. Probably out of the campaigns he had funded for the presidency among other le gislative dockets. In the Business circles, he was an enviable C.E.O, who was practically â€Å"untouchable†. But in the wake of the ethical backlash, all these attributes could not save his company from sinking to the bottom of the sea that is failed companies.            Ethics is more than just producing good products, supporting community initiatives and giving good salaries. Companies with a sound ethical background will go to extents to ensure consumer safety, business fair play and ensuring that employees who served diligently go home safe to retirement. Even after retiring, they will be entitled to the same happiness they had while working for the same company, and health.            All corporations that breach conduct on ethics should be nationalized in order to safeguard the interests of the public. Its owners should then be duly compensated and never allowed to start any other business within the country. Such a law will instill fear and caution among those who have a penchant for breaking the law.            Consumers and the government need to be careful about safeguarding the economic environments. Since any turmoil could lead to financial turmoil like it did with the instability of some few big companies in the early 2000s that lead to the 2007-2009 global financial crunch. The government can help by sealing off all loopholes that could allow any forms of corruption while the consumers could channel their money to the right businesses.            If we all stopped buying brands that do not have its people at heart, all companies and many other manufacturers would forcefully comply duly with laws of labor, taxation, and biosafety. We will have a better world where many Americans and people around the world can eat by their sweat, as opposed to having jobs but still relying on welfare for upkeep.
